Cyrus is called to the stand and he tells the court that he asked to have Winston's arrest record unsealed, but was denied. He says that they were able to obtain the information when an officer volunteered to look into the arrest. Winston asks Cyrus if he knew the officer didn't have the authority to access the record. He says he didn't know. Winston asks if Cyrus is a law student and Cyrus admits he is first year law. Winston then suggests that Cyrus should have known better. The judge tells Winston that it's enough and says that Cyrus knew he was violating the law when he looked at the sealed records. She says that she will have to suppress both the car and the shell casing. Winston then moves to dismiss the charges against him since there is insufficient evidence. The judge asks if there is any further evidence and Michael says no. Michael asks for more time so that they don't have a double jeopardy situation. She gives him 3 days.
Michael, Kevin and Cyrus try to figure out where they will get more evidence. Michael scolds Cyrus for using lawyer speak on the stand. Cyrus tells Michael he wasn't doing a good job of defending him and the two fight. Connie breaks up the fight. She then tells Michael that there is a second murder involving another one of Winston's clients.
Michael calls the judge to meet with him and Winston. Michael asks for a decision to dismiss the case without prejudice. The judge says the case will be dismissed with prejudice. Michael and Winston start to bicker and the judge fines them both $1000 for contempt. She grants Winston's request to have the case sealed.
Connie talks to Mr. Tyler, the lawyer for the defendant in the murder of the first judge from the Flight 33 case. He tells Connie that Mr. Cruise was executed for the murder six months ago. He says that Cruise was part of the class action suit and Winston took the stand against him. He says Cruise's cigarette butts were at the scene of the judge's murder. Cruise tried to say that someone could have stolen the butts and framed him. Cruise said Winston let him smoke in his office, but Winston took the stand and denied it. Connie tells Michael what she learned. Jack arrives and asks to talk to Michael alone. Jack asks if Michael is getting enough sleep. He tells Michael what he needs to keep him from flying off the handle. Michael says he'll be okay. He says Winston is the embodiment of evil who has committed three murders, Charlie, the judge, and Cruise. Jack tells Michael he has work to do.
Connie and Michael talk to Mrs. Cruise. Michael asks how she can explain her husband's cigarette butt at the judges house. She says he smoked outside sometimes. She says someone could have taken his cigarette butts, but couldn't figure out who. Michael asks if they ever suspected Winston. She says no adds that he gave them $100 every year.
Connie and Michael talk to Mr. Tyler. Michael says that Cruise was convicted even though there were no witnesses. Tyler tells Michael that the jury already executed someone for the judge's death and they can't go back. Michael and Connie leave. Michael decides to buy a pack of cigarettes. He then goes to Winston and asks him to sign a letter apologizing for the contempt. Winston agrees. Michael pulls out a cigarette and Winston allows him to smoke in his office. Michael then has a friendly chat with Winston about his class action suit.
Michael goes back to Jack and tells him that he wants to arrest Winston because he let him smoke in his office. Michael says it is a code violation, but also perjury since he testified that he doesn't let anyone smoke in his office during Cruise's trial. Michael adds that his lie caused the jury to sentence Cruise to death, which would make Winston guilty of murder. Jack agrees to go for it.
Kevin and Cyrus walk into an ongoing trial with an arrest warrant for Winston. Winston's lawyer is shocked that they are arresting Winston on such silly charges. During the trial, Winston's lawyer says the case should be dropped. Michael argues that Winston's lies caused a conviction for Cruise which resulted in his execution. The jurors from the case are called to the stand. The first juror says Winston's testimony that Cruise wasn't allowed to smoke in his office made them believe that Cruise was guilty. She says that they believed Cruise was untrustworthy since he lied about such a small thing. She adds that Winston made them believe he really wanted to help his clients. The judge asks if the juror wouldn't have convicted Cruise if Winston hadn't lied about the smoking. The juror says that it would have given them reasonable doubt if they thought someone could have framed him. Mrs. Cruise begins to cry and the judge says that Michael's case is valid. The judge lets Winston to remain free on bond. Michael and Winston start to argue quietly. Michael tells him that all the money he is going to make form the class action suit will be lost when Mrs. Cruise sues him for killing her husband.
Winston faces a committee hearing where they try to figure out if there is merit to the perjury/murder case. The committee decides that he is disqualified from representing the case and will be denied any compensation from the case outcome. Winston waits for Michael asks if he is happy now. Michael jokes that he will send him money that he can use when he's in jail. Winston follows Michael in the bathroom and pulls a gun on him. Kevin and Cyrus bust in and stop Winston from shooting. Michael thanks Cyrus for saving him.
